Site Usage
In order to use this site and be able to bid on property, you must first register. Currently there is no fee to register. Please also see our How to Bid page.
Terms of Use
Each individual choosing to use this site, must act with integrity and honesty. In the event, that this is not the case, your bidding privileges can be revoked at any time. You must review and agree to all the Terms of Sale for each property. At any point that it is found that there are fraudulent activities either on the behalf of the seller or buyer related to the site, we may seek any legal remedies as deemed necessary. As well as, any bidder making fraudulent bids will be banned from this site, indefinitely, without any recourse from the bidder.
Property Bidding
First to bid, you must register. However, you are able to view all properties before registering to bid. All bids will be displayed to view unless noted otherwise.
Property View & Property Information
To view properties, all you need to do is click View Property Data button for that property and you are able to view all features of the property and any terms and conditions regarding property. Fees pertaining to the certain properties are disclosed on the property page.
Bidder Registration:
If you intend to bid on a property, in most cases, registration is all that is required. Bidder information and password information is confidential and may not be shared or transferred to another party.
NOTE: It is highly recommended that you register at least 72 hours before the close of the auction that you would like to bid on, in the event there are any registration problems.
There are no fees required to bid; however, you will need a valid Drivers License in order to register and bid.
User Eligibility
In order to register as a business entity, you must present evidence that you do have the authority to bind the business entity to this Agreement and other real estate related agreements.
Any user bidding on behalf of others shall provide written proof of authority to bid on behalf of that person.

If you would like email notifications you may either subscribe when you register or you may subscribe on the "Home" page. We will update you when new properties are added to BrayBid.com in any area of Kentucky that you request.
Services
BrayBid.com does reserve the right to change our Site Terms at any time relating to fees and other items mentioned in this published document, by our own discretion. Any changes made would be effective immediately and is at the sole discretion of BrayBid.com
Discrepancies in Advertisements
At any point there are any discrepancies between the terms and condition outlined on this site and the terms outlined in the Purchase Agreement, the terms in the Purchase Agreement shall prevail, so read the Purchase Agreement carefully. All dates and times listed on this site supercede any advertisements or printed statements.
Negotiations & Post Auction Activities
Once an online bidding event concludes and the reserve price is not met, the Seller is not under any obligation to negotiate with any bidder. All properties will be offered on a “first come, first served” basis by the Seller.
Final Approval by Seller
Each "Seller" on this site reserves the right to have final approval and acceptance of any and all Purchase Agreements submitted by any broker or bidder, regardless of information provided by this site, any broker, or any BrayBid.com employee or affiliate to the contrary.
NOTE: The "Seller" may lower the reserve price at any time during the auction.
BUYERS COSTS
BID AMOUNT - Final winning bid amount
INTERNET TRANSACTION FEE - The Internet Transaction Fee will be disclosed on each individual property. This fee will be paid by the buyer at closing.
TITLE SEARCH – if desired by the buyer.
TITLE INSURANCE – if desired by the buyer.

DEPOSIT
A minimum $500.00 Deposit is required (this deposit will vary and will be disclosed on each individual property page) when the “Buyer” receives the Sales & Purchase contract via e-mail or mail if requested. The Sales & Purchase contract must be returned to BrayBid.com along with the deposit and a copy of the “Buyer’s” driver’s license within 2 days after receipt of Sales & Purchase contract.

However, if the Buyer or Buyers Lender requests another closing agent all efforts will be made to accommodate that request.
ADDITIONAL TERMS
BrayBid.com, LLC has made agreements with different individuals and corporations etc. (“Sellers”) to market certain properties through an internet bidding system. All of the properties on BrayBid.com are offered subject to the Sellers approval of the price and final terms and condition. These properties will be offered through an internet bidding system. All properties will have an opening and a closing date.
Additional Information
- Sellers will convey bank owned properties by Special Warranty Deed or similar type deed, such deeds and conveyances shall be without covenants, free and clear of all recorded liens, except those liens to be discharged upon closing.
- Properties are being sold in “as-is” condition.
- No improvements or repairs will be made by the Sellers on any of the properties.
Property Inspections
- It is the responsibility of the Purchaser to inspect the properties, any improvements and the immediate surroundings.
- It is the responsibility of the buyer to verify the applicability of and compliance with land use laws, codes, ordinances, zoning laws and any subdivision rules and regulations.
- Any information contained on this website as well as any promotional materials, including but not limited to photos, square footage, dimensions, taxes, acreages, zoning, leases, association dues or dates or ages of the Property, etc. was provided by the Seller and is to be believed accurate, however neither the Seller or BrayBid.com can make any guarantees to the accuracy of this information.
Closing
- All sales will be scheduled to close within 30 to 45 days with no contingencies and contract concessions.
- All bidders are responsible for their own financial arrangements.
- All monies will be deposited and held in the escrow account of BrayBid.com.
- At closing, the Purchaser will be granted possession of the property, unless otherwise noted.
- The Seller may extend the closing date if needed, at their sole discretion.
Sales and Purchase Agreement
- The Sales and Purchase Agreement must be executed and returned to BRAYBid.com by the winning bidder.
- The Sales and Purchase Agreement will contain all terms and conditions of the sale.
- In the event the Purchaser fails to return the Sales and Purchase Agreement along with the required down payment within 2 days the contract will be voided and the property will be offered for sale again.
Seller’s Disclaimer
All properties will be sold on an “as-is, where-is” basis. If the Seller has kept their part of this contract, by furnishing good title, and the Buyer(s) fail to comply with their requirements on or before the closing date, then the money deposited shall be retained by the Seller and agent as damages and divided equally between the Seller and Agent. The Buyer(s) agree that neither BrayBid.com nor the Seller shall be liable for any errors in any description contained in any advertisement or any other description (written or oral).
NOTE: At any point during the bidding process, if an error has occurred on your part while trying to bid; meaning computer failure, non-responsive internet, power failure and any other computer problems. BRAYBid.com is not responsible for your bid not being placed.
