Sellers Terms

SELLER

A seller is anyone who wishes to list their property on BrayBid.com to have their property sold on our online auction website.

“BIDDER”

The “Bidder” must be a registered “Bidder” before placing any bids on BrayBid.com

The “Seller” must agree to all terms before placing their property on BrayBid.com.

BrayBid.com does reserve the right to reject any property or seller under its own discretion.

The “Seller” is not allowed to place fraudgelant bids on the property to inflate the bid price.

An Internet Transaction Fee will be charged to the Buyer, this fee will be disclosed on each individual property page.

The Listing period is as follows:  

  • Pre-auction the time in which the property can be viewed on-line.
  • Auction period 2 weeks (14 days) in which the property will be able to receive bids.  In some case, this may be extended to 3 weeks (21 days).
  • Post auction period.  If the bidding does not reach the reserve price in the 2 week auction period, the seller may continue to accept offers during this post auction period.  The Seller may accept any offer at any time during this time frame and the auction would be over.

    The “Seller” also agrees that offers placed on the property while under contract with BrayBid.com must go through the online auction process.

    NOTE: Carry Over Clause: If someone that bids on the property through BrayBid.com, but the terms were not met and property did not sell Bray Bid.com reserves the right to collect the commission within a 60 day period after the contract has ended. This is only in the event it is sold to someone that was a previous bidder on BrayBid.com on that particular piece of property.

    BrayBid.com is not responsible for the final sale price in the event it is not acceptable to the “Seller”, nor is BrayBid.com responsible for obtaining bids.

    NOTE: The "Seller" may lower the reserve price at any time during the auction.

    Seller” agrees to allow property to be listed on Metro Search, Inc. (Multiple Listing Service). Please see the Multiple Listing Contract.

     

    SELLERS COSTS

    ADVERTISING

    • An up front advertising fee a minimum of  will be due at the signing of the contract. This fee will vary depending the amount of advertising necessary to market the property.

    SURVEY

    • Survey to be performed only upon successful completion of auction contract with the “Buyer”.

    CLOSING COSTS

    • Deed preparation
    • Deed tax
    • Pro-ration of real estate taxes
    • Closing fee to attorney
    • Commission

    ADDITIONAL TERMS

    BrayBid.com, LLC has made agreements with different individuals and corporations etc. (“Sellers”) to market certain properties through an internet bidding system. All of the properties on BrayBid.com are offered subject to the Sellers approval of the price and final terms and condition. These properties will be offered through an internet bidding system. All properties will have an opening and a closing date.

    Additional Information

    • Sellers will convey bank owned properties by Special Warranty Deed or similar type deed, such deeds and conveyances shall be without covenants, free and clear of all recorded liens, except those liens to be discharged upon closing.
    • Properties are being sold in “as-is” condition.
    • No improvements or repairs will be made by the Sellers on any of the properties.

    Property Inspections

    • It is the responsibility of the Purchaser to inspect the properties, any improvements and the immediate surroundings.
    • It is the responsibility of the purchaser to verify the applicability of and compliance with land use laws, codes, ordinances, zoning laws and any subdivision rules and regulations.
    • Any information contained on this website as well as any promotional materials, including but not limited to photos, square footage, dimensions, taxes, acreages, zoning, leases, association dues or dates or ages of the Property, etc. was provided by the Seller and is to be believed accurate, however neither the Seller or BrayBid.com can make any guarantees to the accuracy of this information.

    Closing

    • All sales will be scheduled to close within 30 to 45 days with no contingencies and contract concessions.
    • All bidders are responsible for their own financial arrangements.
    • All monies will be deposited and held in the escrow account of BrayBid.com.
    • At closing, the Purchaser will be granted possession of the property.
    • The Seller may extend the closing date if needed, at their sole discretion.

    Sales and Purchase Agreement

    • The Sales and Purchase Agreement must be executed and returned by the winning bidder.
    • The Sales and Purchase will contain all terms and conditions of sale.
    • In the event the Purchaser fails to return the Purchase Agreement along with the required down payment within 3 days. The contract will be voided and the property will be offered for sale again.

    Seller’s Disclaimer

    All properties will be sold on an “as-is, where-is” basis. If the Seller has kept their part of this contract, by furnishing good title, and the Buyer(s) fail to comply with their requirements on or before the closing date, then the money deposited shall be retained by the Seller and agent as damages and divided equally between the Seller and Agent. The Buyer(s) agree that neither BrayBid.com nor the Seller shall be liable for any errors in any description contained in any advertisement or any other description (written or oral).
